Estates are only required to go through probate if the decedent owned property in their sole name at the time of death. If the decedent held all of their property in joint tenancy with someone else, or if they had a living trust, then a probate is not necessary. Similarly, probate may not be required when all of the decedent’s assets are correctly titled and have a named beneficiary, such as retirement accounts and life insurance policies.
