A probate attorney is only sometimes required for a will to be probated. In some cases, the estate executor may be able to handle the probate process without an attorney. However, certain circumstances require an attorney, such as if the estate is complex or there are disagreements among the heirs. Other times when an attorney may be helpful but not required include when the estate is subject to federal estate taxes or problems with the will itself. Even if an attorney is not required, hiring one may still be in your best interest. Probate can be complicated, and an experienced attorney can help you immensely.
