Probate property is any asset titled in the decedent’s name alone. This includes:
-Bank accounts
-Investment accounts
-Real estate (including vacation homes)
-Vehicles
-Business interests
Some assets, even if titled in the decedent’s name alone, may not be subject to probate because they have a named beneficiary. These include:
-Retirement accounts (IRA’s, 401(k)’s, etc.)
-Life insurance policies
-Payable on death (POD) accounts
-Transfer on death (TOD) brokerage accounts
